TWO men sexually assaulted a drunken woman who “was out of it”, Oxford Crown Court heard today.

Mohammed Shahjahan, 27, of Slaymaker Close, Headington, Oxford, and Feisal Ali, 25, of Howard Street, East Oxford, both deny assault by penetration.

Shahjahan also denies one count of rape.

Neil Moore, prosecuting, told the jury the assaults took place at an address in East Oxford on November 14 last year.

The court heard the incident took place after the victim had been drinking vodka and Red Bull with the two men. She woke up in the early morning, returned home and told police of the assault two weeks later.

The two men were subsequently arrested and officers seized two sequences of video footage from a mobile phone which depicted the attack, the court was told.

Mr Moore said: “She will tell you she did not give her consent for any defendant to perform any sexual act upon her.

“She did not give anyone consent to film her having sexual acts performed upon her.

“You will be in no doubt when you look at the video that she was not consenting – she was out of it and beyond the stage where she had the chance to consent to sexual acts being performed upon her.”

The court also heard a photo retrieved from the mobile phone showed Shahjahan raping the victim in a bedroom.

The jury was shown a video of the victim’s police interview, in which she said the whole situation made her feel angry and upset because someone had taken advantage while she was “passed out and drunk”.
