CRICKET: Red tape denies Myburgh

Oxford Downs hopes of playing overseas star Johann Myburgh have suffered a big setback due to a complicated dispute over his visa.

Myburgh is in the UK on a general visitor’s visa, rather than a sports visa, but the club insist it was an error with the UK Border Agency, rather than themselves.

Myburgh has a first class batting average of 44.66 as well as taking 27 wickets.

Last year, he scored 80 against a full England side, but it seems he will not be able to play for the Oxford Times Cherwell League club.

Cherwell League secretary Peter Tomlin said: “Johann Myburgh came to the UK on a general visitor’s visa, rather than a sports visa.

“Based on that, we cannot register him for the Cherwell League, it’s as simple as that.

“He could only play cricket if he entered the UK on a sports visa.

“The UK Border Agency say that there are certain exclusions to a visitor’s visa, one of them being that you cannot play sport as an amateur for an amateur club.”

It would appear that the only way Myburgh could play this year is by returning to his native South Africa and re-applying for a sports visa.

No-one at Oxford Downs was available for comment.

Meanwhile, Shipton-under-Wychwood’s overseas player Romesh Eranga has also had his registration suspended, although his situation remains less clear-cut.

Shipton initially wanted to sign Eranga on a tier five visa, which would allow them to pay the player.

Tier five visas cover working holidays and also cater for specific temporary employment opportunities such as professional sport.

But it emerged that it could take several months to arrange this visa, so the club changed tack and organised a sports visa for Eranga.

Tomlin said: “Shipton have provided us with copies of both his contract and visa, and at the moment the lawyers are examining the paperwork.”

Shipton skipper Paul Hemming said: “We are hopeful that Romesh can play for us this season. We just have to provide evidence that we had already sorted out the agreement before the league’s cut-off date for tier five players, which we have sent to them.

“So it’s just a case of waiting for a decision from the league.”

Tomlin added that the only cut-off date the league had set was February 15. Any players signed up for paid contracts before this date are still eligible for this season.

Indeed cant wait for this one to kick off..how many other overseas players of a lesser profile are over here on a sports Visa????Not all of them would be My Guess.....thats all it is though a guess...I recon we could beat the Ton on this one if the Om dont pull the plug too early

It's not as complicated for Aussies, Kiwi's and some others as they are non-VISA nationals. Those from non-VISA national countries can come in on working VISA's and they are OK - and fine to play in Cherwell too of course.

Unfortunately, the UK Borders people won't allow those on the VISA national list (which incl S Africa) to come in and play sport unless they have a sports VISA.

Clear? Thought not!!

Unfortunately it is not League rules - it is UK Border Agency rules.

Cherwell League have no real leeway on the matter to be fair. And being fair to the Cherwell League is not something that comes easily! :-)

That is right it is ****.... The Cherwell league misses out and the player miss out. I'm sure dispite all the moaning that at least a few bowlers would have fancied bowling at him.

The UKBA should have a Barman Visa for South Africans not a Sports Visa.

Anyways the rumour is the Cherwell League had cleared him to play before his departure, so another f*ck-up from them!!!!!

I still dont understand why Downs went for someone so good, was Myburgh supposed to make up for the loss of Milligan, Sandbach and Perkins? Without the remaining players being that good there is no way they could sustain their league position when he left. Am I missing the point here?

Originally, we had Dougie Bracewell lined up but that went t*ts up when Gloucester snapped him up. Then there was some other SA meant to be coming and he went to Lancashire league. Myburgh was a last minute thing.

Anyone else playing SOA at Bloxham school today?

Yeah, really. I can imagine the powers that be in NZ cricket being very impressed with a short stint doing charity work in Oxfordshire club cricket. Extremely career enhancing that.

Rowledge are a good side, will be a tough one to beat. As for Mike Sutliff, i dont know about the eligibility but i do know he doesnt play any sunday cricket. I would imagine if that game is a problem though, that Wisden would give the same option they offered Downs, a replay. Bit late now id say. At least we dont have an overseas star and we dont pay anyone!!

I know he played in that game, but he only played because there was no game on the saturday and his wife let him! I assume you mean the 2 year rule? If so, then Wisdens standpoint was that it was ambiguous wording and offered a replay to Downs. The major issue everyone has with Downs and to a certain extent Rowant is the overseas players/paid players question. Mike got over 900 runs in the league for us last year and qualifies in the amount of games played was the standard eligibility rule for years and years until, apparently this year when they made a balls up of the rule wording

THe funny thing is most of the smaller teams in the Bucks group play overseas players if they have them, and even ringers from other clubs but we dont complain, we just beat them and move on

Yeah - got internet access here. Fairly chilled to be honest. Been doing a lot of grooving in the nets - keeping myself sharp. Got to invigilate an exam this afternoon though. Disappointed not to be featuring for Downs. But enjoyed a nice relaxing bath with Ted on Sat night so not all bad. Shared a prized bottle of Grand-Puy-Lacoste - 1996 Vintage Bordeaux. Special.

Power....my point is he is ineligable to play on the basis he joined you last year...thats why Downs have withdrawn over Lester Smart I believe....Thats what the paper statements said from Downs...so your club has broken the rules as Downs did and if anyone challenged wisden over it you may have problems...so be careful.

Downs withdrew for their own reasons. They were offered a replay as the wording of the rule was admitted by Wisden to be 'ambiguous'. Dinton have never played anyone in the NVKO that does not play for the club on saturdays and no-one that has not played for at least a year, as the previous years rules had been stated. For the record I think Downs should have replayed as they were offered one and hadnt done anything wrong in that regard. Neither us nor Downs broke the rules in that context, and I think if Downs had no other reason to withdraw they should have taken the option that was offered them. The fact that so much controversy surrounds their 'other' issues clouds things as far as they are concerned

Mr Singh, Wisden have actually re-worded the rule on the Village cup website as it was deemed to be ambiguous. It is no longer ambiguous as they have changed the wording following the Downs problem. If you have a problem understanding this please let me know. There are undoubtably a lot more clubs who this applies to, as the rule was changed this year but was not made clear so get off your moral high horse

I would recommend taking out a restraining order which bars him from coming within 500 yards of Dinton. They also have a guy called Arif who is a compulsive hooker if you bowl at his face he hits it up in the air

SOA game was a cracker. SOA 224-3 declared, G.Kennedy 92no, T.Hardy 53, F.Crouch 54. Bloxham school 224-7. Opening bat scored really good 104no. they hit 4 off of last ball to tie.

If the weather's good will probably chill round the pool all day, chase the muff around. Break down. More than happy to pull a shift behind the bar though. Keen to catch us demolish the Lions - Jamie Roberts is sooooo strong - I love his jaw line...so manly. Will be a cracker. Entered a Karaoke competition in Witney tomorrow night - will be singing "I'm you're Angel" by Celine Dion. If the cricket doesn't work out, Ted said he'd give me a gig at the Downs every Sat night for the rest of the season. I tend to deal mainly in classic love ballads, but would have no qualms indulging in some funk rock / acid jazz for the more harcore Downs members. Easy now. JM
