A DISABLED man accused of sexually abusing a child told jurors the sex acts would have been 'impossible' because of a physical condition.

Prosecutors at Oxford Crown Court claim that Mark Fysh, who has cerebral palsy, sexually touched his victim over her clothing and forced her to rub his genitals on multiple occasions.

The instances of alleged abuse are claimed to have taken place between November 1985 and November 1987.

As his trial continued yesterday the 60-year old of Whitecross, Wootton, near Abingdon, told jurors that none of the alleged incidents of abuse ever took place and said his physical ailments would have made any 'spontaneous' sexual acts impossible.

Speaking of his physical condition the retired local government officer - who is now confined to a wheelchair - told jurors that the impact on his daily life was 'considerable'.

He said: "It is considerable, it has always been considerable, I have been disabled since birth, it does actually affect my whole body.

"My left side has always been weaker than my right side, I have always fallen over very frequently.

"I need to make very, very clear from my 20's I have always been in pain, always. I have always had to take painkillers, it never, ever goes away, every single minute of the day, even now."

Asked by his defence barrister Tunde Okewale about the specific allegations made by the single alleged victim Fysh said that none of the abuse had ever happened.

Fysh went on to say that a physical condition he has called 'buried penis' would make any kind of impromptu sex acts impossible to carry out.

Speaking of one specific instance of alleged abuse he said: "It didn't happen, it could not happen, it is just not possible.

"It is not something that can be done on a spontaneous basis."

Asked again about the truth of the claims made against him he said: "I utterly refute all the allegations."

Earlier in the trial jurors heard a police interview made with the alleged victim - who cannot be named for legal reasons - in which she described to officers her ordeal.

Speaking of one instance of alleged abuse she said: “I remember sitting on the sofa and he would come and sit by me.

“I had a reaction like any teenager. I used to get really red and embarrassed. It was my personal space.

“I did not really like it but he managed to get under my defences and eventually it was ok.

“I did not listen to my instincts. It just became something that was ok."

She claimed this led to an incident in a bathroom before further abuse was carried out by Fysh, including touching her on several occasions as well as kissing and touching while on the landing of his home while others were downstairs.

Fysh denies all seven counts alleging indecent assault as well as two counts alleging indecency with a child.

The trial continues.
